Your booking is final once you have completed and submitted the registration form. Upon booking your trip, you will receive an invoice from us for a deposit of 25% of the total price. A trip will take place from 10 persons. With fewer participants, CYCLOsportive reserves the right to adjust the trip in parts. CYCLOsportive will inform the participants about this and offer the choice to participate in the adjusted trip or offer the possibility to cancel the trip without costs. CYCLOsportive also has the right to cancel the trip if there are too few participants. General terms and conditions CYCLOSportive<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

These conditions come into effect on January 1, 2018 for agreements concluded on or after that date.<\/p>

Article 1: Definitions<\/h2>

In these terms and conditions and the applicable agreement, the following definitions apply:<\/p>

1. Outdoor sports: all sporting or recreational outdoor sports in which one can participate under supervision or with prior instruction and which mainly involve physical exertion and an adventurous experience, both indoors and outdoors; Also motorized if not intended as public transport.<\/p>

2. Arrangement: Service or activity or combination of services or activities organized or offered by the entrepreneur on a business or professional basis, as well as the provision of facilities. These services, activities or facilities may consist of the rental or sale of equipment, arranging transport or activities, arranging (staying) accommodation(s), providing instruction and supervising (parts of) a program of activities. Supervised arrangements or supervised activities are understood to mean: arrangements or activities that are supervised by a representative of the entrepreneur.<\/p>

3. Service: all actions in preparation for or support for the performance of outdoor sports. This includes, among other things, the rental or sale of equipment, arranging transport, providing accommodation(s), providing instruction and supervising (parts of) outdoor sports.<\/p>

4. Activity: outdoor sport or service or combination of outdoor sport and service organized or offered by the entrepreneur on a commercial or professional basis.<\/p>

5. Supervised activities: activities that are supervised by (a representative of) the entrepreneur.<\/p>

6. One-day activity: an activity offered by an entrepreneur that does not last longer than 24 hours in total and does not include an overnight stay.<\/p>

7. Multi-day activity: an activity offered by an entrepreneur that lasts longer than 24 hours in total or that includes an overnight stay.<\/p>

8. One-day package: A service or activity, or a combination of services
or activities offered by an entrepreneur that last no longer than 24 hours in total and do not include an overnight stay and include at least 1 half-day.<\/p>

9. Multi-day package: A service or activity or a combination of services and activities offered by an entrepreneur that lasts longer than 24 hours in total and which in any case includes an overnight stay.<\/p>

10. Entrepreneur the person who, in the exercise of his profession or business, offers activities and\/or materials; Representative of the entrepreneur: the person who acts on behalf of the entrepreneur.<\/p>

11. Contractor: any natural person or legal entity who concludes an agreement with the entrepreneur for himself or on behalf of third parties.<\/p>

12. Participant: any natural person who actually participates in or uses an arrangement and\/or activity.<\/p>

13. Agreement: agreement between the entrepreneur and the contractor regarding an arrangement or activity.<\/p>

14. The agreement must be regarded as a travel agreement if the entrepreneur undertakes to provide a trip organized in advance by him that includes an overnight stay or a period of more than 24 hours as well as at least two of the following services: 1) transport, 2) accommodation, and 3) another tourist service not related to transport or accommodation, which constitutes a significant part of the package.<\/p>

15. Agreed price: the compensation paid by the contractor for the activity; it must be stated in writing what is included in the price.<\/p>

16. Information: written\/electronic data about the activity.<\/p>

17. Cancellation: the written termination of the agreement by the contractor before the start of the activity.<\/p>

Article 2: Scope<\/h2>

1. These conditions apply to all quotations, offers and agreements made by or on behalf of the entrepreneur, unless expressly deviated from in writing in the agreement.<\/p>

2. The conditions are known to both parties when entering into the agreement. The contractor accepts the applicability of these conditions by entering into an agreement with the entrepreneur or actually participating in an activity or by paying the agreed price or part thereof.<\/p>

3. In the event of any conflict between these terms and conditions and the general terms and conditions of the contractor, the terms and conditions of the entrepreneur shall prevail. This does not affect the fact that the contractor and the entrepreneur can make individual additional written agreements whereby these conditions are deviated from for the benefit of the contractor and\/or the participant.<\/p>

4. The entrepreneur is only bound by the agreement and\/or amendments thereto and\/or additions thereto if the contractor has accepted them in writing.<\/p>

Article 3: Price change<\/h2>

If, after the agreed price has been determined, additional costs arise as a result of an increase in charges on the part of the entrepreneur as a result of a change in charges and\/or levies that directly relate to the activity or to the participant and\/or contractor, these can be charged to will be charged to the contractor, even after the conclusion of the agreement.<\/p>

Article 4: Payment<\/h2>

1. The contractor must make payments in euros, taking into account the terms agreed by the company, unless otherwise agreed and recorded in writing.<\/p>

2. If the contractor, despite prior written notice, does not or does not properly fulfill his payment obligation within a period of two weeks after the written notice, the entrepreneur has the right to terminate the agreement with immediate effect, without prejudice to the entrepreneur's right to full payment of the agreed price.<\/p>

3. If the entrepreneur is not in possession of the total amount due on the day the activity starts, he is entitled to deny the participant participation in the activity, without prejudice to the entrepreneur's right to full payment of the agreed price. .<\/p>

4. The extrajudicial costs reasonably incurred by the entrepreneur after a notice of default will be borne by the contractor. If the total amount is not paid on time, the legally determined interest rate on the outstanding amount will be charged after written notice.<\/p>

5. The right of the contractor to settle its claims against the entrepreneur is expressly excluded unless the entrepreneur becomes bankrupt.<\/p>

6. The full claim for payment is immediately due and payable if:
a. a payment term has been exceeded
b. the contractor is bankrupt or is in suspension of payments
c. the contractor or his company is dissolved
d. the contractor as a natural person is placed under guardianship or dies<\/p>

Article 5: Early departure by the participant<\/h2>

In the event of premature departure by the participant, the contractor owes the full price for the agreed activity.<\/p>

Article 6: Obligations of the contractor<\/h2>

1. The contractor must ensure that the participants comply with the conduct and house rules applied by the entrepreneur.<\/p>

2. When carrying out an activity abroad, the contractor ensures that the participants are in possession of all documents that are required in the country of destination or transit countries, such as a valid passport or identity card, any visas, proof of vaccination, etc. If the participant cannot participate in (part of) the activity due to the lack of a required document, the entrepreneur is not liable.<\/p>

3. The entrepreneur reserves the right to use photographic or other recordings made during the arrangement or activity for promotional purposes. Objections to this must be submitted in writing within 14 days of admission.<\/p>

4. Alcohol use prior to and during the activity is prohibited, with the exception of activities such as tastings. This should be performed as the last activity.<\/p>

Article 7: Early termination by the entrepreneur<\/h2>

1. The entrepreneur can terminate the agreement with immediate effect:
If the contractor or participant does not or does not properly comply with the obligations under the agreement, the associated information and\/or government regulations, despite prior warning, to such an extent that, according to the standards of reasonableness and fairness, the entrepreneur cannot be expected to the (participation in the) activity is continued.<\/p>

2. The entrepreneur can exclude a participant from further participation in the activity and terminate the agreement with this participant if, despite prior warning, the participant causes nuisance to the entrepreneur and\/or fellow participants, or the safety of himself and\/or others. endangers or deals with nature and the environment in an irresponsible manner or spoils the good atmosphere at or in the immediate vicinity of the activity.<\/p>

3. All resulting additional costs will be borne by the contractor.<\/p>

4. If the entrepreneur or representative wishes to cancel prematurely, he must inform the participant personally and he must also inform the contractor of this.<\/p>

5. The contractor remains in principle obliged to pay the agreed price.<\/p>

Article 8: Changes to the agreement<\/h2>

1. If, at the request of the contractor, the entrepreneur changes the content of the agreement, the entrepreneur has the right to charge additional costs.<\/p>

2. An amendment to the agreement also occurs if the information provided by the contractor does not correspond to reality.<\/p>

3. If the entrepreneur decides to change the agreement, he will offer the contractor an alternative. If the contractor rejects this alternative, he must immediately report this to the entrepreneur. In this case, the contractor is entitled to a full refund of monies already paid relating to the parts of the activity not enjoyed.<\/p>

4. A participant who is prevented from participating in the activity can - after the agreement of the contractor and the entrepreneur - be replaced by another person under the following conditions:
a. the substitute must meet all conditions attached to the agreement,
b. the request for substitution must be made no later than 7 days before the start of the
activity must be submitted to the entrepreneur in writing,
c. the conditions of the service providers involved in the performance of the activity do not preclude the substitution.<\/p>

Article 9: Unenforceability of the agreement<\/h2>

1. The entrepreneur has the right to suspend or terminate the execution of the agreement in the event of serious circumstances that are unforeseen and cannot be remedied or avoided, such as (civil) war, terror, political unrest, natural disasters, food shortages. , general strikes, weather conditions, etc. The entrepreneur is obliged to inform the contractor immediately and stating the reasons for the termination.<\/p>

2. The entrepreneur has the right to terminate the agreement in whole or in part if, in the opinion of the entrepreneur, the participant's physical condition makes him\/her unsuitable for (further) participation in the activity.<\/p>

3. The entrepreneur has the right to terminate or suspend the agreement if there are too few participants for a group activity.<\/p>

4. If compliance becomes permanently impossible, the agreement can be terminated for that part that has not yet been fulfilled. In that case, neither party is entitled to compensation for the damage suffered as a result of the dissolution.<\/p>

5. A group trip starts with 10 participants. The trip is not feasible below this number of participants. The entrepreneur will inform the participants of the number of participants no later than 3 months before the planned travel date. If a trip has too few participants, the entrepreneur has the right to cancel the trip. In that case, the entrepreneur will offer the participant an alternative or propose to refund the full travel price. If the trip does not include transportation and the participant has incurred costs for transportation, these costs are the responsibility of the participant.<\/p>

Article 10: Complaints<\/h2>

1. If the participant discovers a shortcoming in the execution of the agreement, he must report this as soon as possible so that an appropriate solution can be found.<\/p>

2. If the complaint is not resolved satisfactorily on site, the contractor can do this,
notify the entrepreneur in writing and with reasons within 14 days after the end of the activity.<\/p>

Article 11: Liability<\/h2>

1. The entrepreneur is not liable for an accident, theft or damage unless this is the result of a shortcoming attributable to the entrepreneur.<\/p>

2. The entrepreneur is not liable for the consequences of extreme weather conditions or other forms of force majeure.<\/p>

3. The contractor is liable to the entrepreneur for damage caused by the participant's actions or omissions insofar as this concerns damage that can be attributed to him.<\/p>

4. The entrepreneur undertakes to take appropriate measures after the participant reports nuisance caused by other participants.<\/p>

6. The participant is and remains responsible for assessing whether he\/she is in sufficient condition to practice the relevant activities.<\/p>

Article 12: Legislation and regulations<\/h2>

1. The entrepreneur ensures at all times that the activity meets all environmental and safety requirements that the government may impose on the activity.<\/p>

2. The participant is obliged to strictly comply with all safety regulations applicable to the activity.<\/p>

Reisvoorwaarden Boeking: De boeking is definitief zodra het inschrijfformulier is ingevuld en verzonden. Bij boeken van de reis ontvang je van ons een factuur om een aanbetaling te voldoen van 25% van de reissom. Uiterlijk 12 weken voor aanvang van de reis zal CYCLOsportive de eindfactuur verzenden voor het restbedrag. Deelnemers: Een reis gaat door vanaf 10 personen. Bij minder deelnemers behoudt CYCLOsportive zicht het recht voor om de reis op onderdelen aan te passen. CYCLOsportive zal de deelnemers hier over informeren en de keuze voorleggen deel te nemen aan de aangepaste reis of de mogelijkheid bieden de reis zonder kosten te annuleren. Tevens heeft CYCLOsportive het recht de reis te annuleren wanneer er te weinig deelnemers zijn. Deelnemers zullen hier tijdig (uiterlijk een maand voor de reisdatum) over worden ge\u00efnformeerd en krijgen dan de reissom retour. Veiligheid\/aansprakelijkheid: De deelnemers aan de reizen van CYCLOsportive zijn zelf verantwoordelijk voor het afsluiten van een verzekering die risicovolle sporten dekt. Deelname is volledig op eigen risico. CYCLOsportive aanvaardt geen aansprakelijkheid voor persoonlijk letsel of schade aan eigendommen van deelnemers. Boek je een reis bij CYCLOsportive dan gaan wij er vanuit dat je de algemene voorwaarden gelezen hebt en ga je automatisch akkoord met deze voorwaarden.\u00a0 Wachtlijst: Ben je op de wachtlijst geplaatst? Dan laten we zsm weten of er plek is. Na onze bevestiging dat er plek is, krijg je de kans om jouw boeking definitief te maken. Met de bevestiging sturen wij ook de factuur voor het doen van de aanbetaling. Laat het ons binnen 24 uur na het ontvangen van de factuur weten als je afziet van jouw plek op onze reis. Na 24 uur is jouw boeking definitief en is jouw plek bij de Maratona gegarandeerd. Annuleren: Indien je zelf beslist te annuleren, maar CYCLOsportive kan de reis wel uitvoeren. Reis inclusief vlucht: Is jouw reis inclusief vlucht? De vluchtprijzen zijn flexibel. Op moment van boeken, boeken wij ook jouw vliegticket. In de reissom is er rekening gehouden met een basissom voor het vliegticket. Kan zijn dat er een factuur gestuurd wordt als de vliegtickets duurder blijken te zijn dan het bedrag waar in de reissom rekening mee is gehouden. Granfondo gaat niet door: Organisaties zetten de startbewijzen over het algemeen niet door naar het volgende jaar. Startbewijzen komen niet in aanmerking voor restitutie. Kosten startbewijs: CYCLOsportive zal zich (ondanks bovenstaande) inspannen om startbewijzen door te zetten naar het volgende jaar. Lukt dit niet dan zullen we ons inspannen om een refund bij de organisatie aan te vragen. Als doorzetten van het startbewijs en een refund niet mogelijk zijn, dan kunnen deze kosten niet verhaald worden op CYCLOsportive. VZR Garant Om te voldoen aan de wettelijk verplichte garantiestelling maakt CYCLOsportive gebruik van de garantieregeling VZR Garant (www.vzr-garant.nl). U kunt dit controleren via de deelnemerspagina van de website van VZR Garant. Binnen de grenzen van de Garantieregeling (te vinden op de website van VZR Garant) is de garantie van VZR Garant van toepassing. Buitensport: alle sportieve of recreatieve buitensport waaraan onder begeleiding, dan wel met voorafgaande instructie, kan worden deelgenomen en waarbij voornamelijk lichamelijke inspanning en avontuurlijke beleving een rol speelt, zowel indoor als outdoor; Ook gemotoriseerd indien niet bedoeld als openbaar vervoer. 2. Arrangement: Door de ondernemer bedrijf- of beroepsmatig georganiseerde of aangeboden dienst of activiteit of combinatie van diensten of activiteiten, alsmede het bieden van faciliteiten. Deze diensten, activiteiten of faciliteiten kunnen bestaan uit de verhuur of verkoop van materiaal, het verzorgen van vervoer of activiteiten, het verzorgen van (verblijfs)accommodatie(s), het geven van instructie en het (laten) begeleiden van (delen van) een programma van activiteiten. Onder begeleide arrangementen of begeleide activiteiten wordt verstaan: arrangementen of activiteiten die door een vertegenwoordiger van de ondernemer worden begeleid. 3. Dienst: alle handelingen ter voorbereiding dan wel ondersteuning van de uitvoering van buitensport. Hieronder wordt onder andere verstaan de verhuur dan wel verkoop van materiaal, het verzorgen van vervoer, het verzorgen van accommodatie(s), het geven van instructie en het (laten) begeleiden van( delen van) buitensport. 4. Activiteit: door de ondernemer bedrijfs- of beroepsmatig georganiseerde dan wel aangeboden buitensport of dienst of combinatie van buitensport en dienst. 5. Begeleide activiteiten: activiteiten die door (een vertegenwoordiger van) de ondernemer worden begeleid. 6. Eendaags activiteit: een activiteit die door een ondernemer wordt aangeboden en die in totaal niet langer duurt dan 24 uur en waar geen overnachting bij is inbegrepen. 7. Meerdaags activiteit: een activiteit die door een ondernemer wordt aangeboden en die in totaal langer duurt dan 24 uur dan wel waarbij een overnachting is inbegrepen. 8. Eendaags arrangement: Een dienst of activiteit, of een combinatie van dienstenof activiteiten die door een ondernemer wordt aangeboden en die in totaal niet langer duurt dan 24 uur en waar geen overnachting bij is inbegrepen en minimaal 1 dagdeel omvat. 9.
